widow marrying a widower and a prenup?
I spoke with a lawyer about a pre-nup and found out it could cost $3-4,000! Thats a lot of money that I really don't want to spend. I was thinking it would be around a $1,000. Anyway I am a widow marrying a widower. We both own homes that we will be selling and purchasing a new home. That is going to be be split as far as expenses. He wasn't left much money by his wife and has very little in assests. There is a trust fund for his children and his expenses. I have a large insurance policy and 401K that my husband left me. Right now the insurance policy is in an annuity which I believe he has no claim to. He would have to sign a waiver so that my children have rights to my 401.
If my money is protected in that way do I really need to do a pre-nup or is it better if I do a detailed will???

Since yours is a very fact specific situation you should consult a local attorney. While $3 - $4,000.00 may seem like a lot of money, it's a small price to pay to be assured that your children's inheritances are secure.
Have the consultation and let the attorney know if you have financial limitations so he can make suggestions accordingly.
