widow marrying a widower and a prenup?

I spoke with a lawyer about a pre-nup and found out it could cost $3-4,000! Thats a lot of money that I really don't want to spend. I was thinking it would be around a $1,000. Anyway I am a widow marrying a widower. We both own homes that we will be selling and purchasing a new home. That is going to be be split as far as expenses. He wasn't left much money by his wife and has very little in assests. There is a trust fund for his children and his expenses. I have a large insurance policy and 401K that my husband left me. Right now the insurance policy is in an annuity which I believe he has no claim to. He would have to sign a waiver so that my children have rights to my 401. If my money is protected in that way do I really need to do a pre-nup or is it better if I do a detailed will???
