     prenuptual agreements and marital lawsuits  

 
My fiance and I reside in the state of New York and were wondering if we both get our own attorneys to represent each of us regarding our prenuptual agreements is anything listed under separate property exempt from marital future disasters like law suits or any legal suits? The reason I ask is this would be the 2nd marriage for me and my fiance and although he had declared backruptcy 4 years ago, and really has no assets now to speak of, he is also very concerned that all my assets previous to our upcoming marriage be drawn up and listed as separate property in both of our premarital agreements and be totally safeguarded from any diasters which may befall either of us after we marry. Please advise and I thank you in advance.

One of the primary purposes of a prenup is to protect each party's premarital assets. The reason it is suggested each party retain his/her own attorney is to ensure that each of your interests are protected.
